OVERVIEW
This website and any related online or technology services are owned and operated by MENA Events, LLC (“MENA Events,” “we,” “us,” or “our”) in connection with OC MENA Festival (the “Event”). These Terms of Use (“Terms”) govern your access to and use of our “Digital Services,” which may include, as applicable: our websites (including subdomains and subpages), mobile applications (if any), email communications, online advertising, and SMS/text message programs, our official social media pages, and any content, features, and tools made available on or through our Digital Services. Digital Services may also include on-site technology you interact with at the Event or related venues (for example, Wi-Fi access, Bluetooth beacons, QR check-in, or interactive kiosks).
Please read these Terms carefully. By accessing or using any Digital Service, you agree to these Terms. If you do not agree, do not use our Digital Services.
ARBITRATION AND CLASS ACTION WAIVER NOTICE
These Terms include a dispute resolution provision that generally requires binding, individual arbitration (instead of court) and includes a class action waiver. This means disputes are typically decided by an arbitrator, and you may be giving up the right to a judge or jury trial and the ability to participate in a class action. See “DISPUTE RESOLUTION, ARBITRATION, AND CLASS WAIVER” below.
WHO WE ARE
MENA Events, LLC produces and operates OC MENA Festival and may operate related websites, pages, communications, and other digital experiences connected to the Event. References to “MENA Events,” “we,” or “our” include our owners, contractors, service providers, and affiliates acting on our behalf for the Digital Services.
PRIVACY POLICY
Our Privacy Policy explains how we collect, use, and share information when you use our Digital Services or otherwise interact with us. By using our Digital Services, you acknowledge that you have read and understood our Privacy Policy.
BINDING CONTRACT; ELIGIBILITY
These Terms form a binding agreement between you and MENA Events, LLC. You represent that you are legally able to enter into a contract and that you are not prohibited from using the Digital Services under applicable laws.
Our Digital Services are not intended for children. If you are under 18, please do not use the Digital Services unless a parent or legal guardian provides permission and supervises your use, to the extent allowed by law.
OTHER AGREEMENTS
These Terms apply in addition to any other terms that may apply to specific services, purchases, or event attendance (for example, ticket terms, venue policies, or contest rules). If a separate written agreement specifically conflicts with these Terms for a particular service, that separate agreement will control for that limited purpose.
THIRD-PARTY SERVICES AND CONTENT
Our Digital Services may include links to, integrations with, or references to third-party websites and services (for example, ticketing platforms, payment processors, maps, or social networks). Your use of third-party services is governed by their own terms and privacy policies, not these Terms. We do not control and are not responsible for third-party content, availability, or practices.
You agree that any reliance on third-party statements, products, or services is at your own risk. To the fullest extent permitted by law, you agree to hold us harmless from claims arising from third-party content, products, or services.
RESTRICTED ACTIVITIES
You agree not to do any of the following in connection with the Digital Services:
- Violate any applicable law or encourage others to do so.
- Collect, harvest, or store personal information about other users without authorization.
- Impersonate any person or entity or misrepresent your affiliation.
- Post, transmit, or promote content that is unlawful, defamatory, harassing, hateful, threatening, obscene, or otherwise objectionable.
- Infringe intellectual property rights, privacy rights, or other legal rights of any person or entity.
- Remove, obscure, or alter branding, copyright notices, or other proprietary notices.
- Send spam, bulk messages, chain letters, pyramid schemes, or unauthorized promotions or solicitations.
- Disrupt, interfere with, or compromise the security, integrity, or performance of the Digital Services.
- Introduce malware or harmful code, attempt denial-of-service attacks, spoofing, or similar technical abuse.
- Attempt to access non-public areas or systems without authorization.
- Circumvent content controls, access restrictions, digital rights management, or usage limits.
- Ignore commonly recognized preference signals or technical measures intended to limit automated access.
- Use hidden text or meta tags in a way that misuses our names, marks, or branding.
- Reverse engineer or attempt to derive source code or underlying components of the Digital Services.
- Assist or encourage others to engage in prohibited conduct.
AUTOMATED ACCESS; SCRAPING; AI/ML RESTRICTIONS
Unless we provide prior written consent, you may not use bots, spiders, scrapers, scripts, or other automated means to access, monitor, copy, extract, or compile material from the Digital Services in high volume. You may not use the Digital Services or any content, data, or materials from them to build, train, fine-tune, benchmark, or operate machine learning or AI systems, or to create data sets or databases through automated collection.
Public search engines may index publicly accessible pages unless we indicate otherwise (for example, via robots.txt or similar controls).
INTELLECTUAL PROPERTY; TRADEMARKS
All content and materials made available by us—including text, graphics, branding, design elements, audio/visual materials, and the selection and arrangement of these materials (collectively, “Content”)—are owned by MENA Events or used under license and are protected by intellectual property laws. Trademarks and logos appearing on the Digital Services belong to their respective owners and do not necessarily imply endorsement.
PERMITTED USE OF CONTENT
You may access and use Content only for personal, non-commercial purposes in accordance with these Terms. You may download or print a single copy of Content for personal use, provided you do not remove or alter proprietary notices. Any other use—including copying, modification, distribution, republication, data extraction, data mining, or commercial exploitation—is prohibited without our prior written consent.
LINKS TO OUR DIGITAL SERVICES
You may link to publicly available pages of our Digital Services as long as the link is accurate, not misleading, and does not suggest sponsorship or affiliation. The linked page must display in full without framing, overlays, or modifications that change how the page appears. We may revoke linking permission at any time.
CONTENT COMPLAINTS
If you believe content on our Digital Services violates these Terms or is inappropriate, contact us using the information in “CONTACT US.”
DMCA: NOTIFICATION OF CLAIMED COPYRIGHT INFRINGEMENT
If you believe your copyrighted work has been used on our Digital Services in a way that constitutes infringement, you may submit a written notice under the Digital Millennium Copyright Act (DMCA). Your notice should include: (a) your name and contact information; (b) a statement under penalty of perjury that you are the owner or authorized to act on the owner’s behalf; (c) a description of the copyrighted work; (d) identification of the material you claim is infringing and where it appears (URL if available); (e) a good-faith statement that the use is not authorized; (f) a statement that the information is accurate; and (g) your physical or electronic signature.

We may remove allegedly infringing material and, in appropriate circumstances, limit access for repeat infringers.
USER-SUBMITTED CONTENT
If our Digital Services allow you to post, upload, or submit content (“User Content”), you remain responsible for your User Content and any consequences of submitting it. We do not endorse User Content and are not responsible for it.
By submitting User Content, you grant MENA Events a nonexclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, display, distribute, modify, and create derivative works from that User Content in connection with operating, improving, promoting, and providing the Digital Services and the Event, including use of any name, handle, or publicly shared profile information you provide with the submission.
We may remove or restrict User Content at any time, but we are not required to do so.
REMOVAL REQUESTS FOR MINORS (CALIFORNIA)
Where required by California law, minors may request removal of content they posted. Requests should include the minor’s name, a description of the content, and the location (URL) of the content, sent to the contact information below. Removal may not be comprehensive in all cases (for example, where content has been reposted by others).
TEXT MESSAGING PROGRAMS
If you enroll in any SMS/text message program we operate, you consent to receive recurring messages at the mobile number you provided. Consent is not a condition of purchase. Message and data rates may apply.
To get help, reply HELP to the number that messaged you. To opt out, reply STOP or another supported opt-out keyword. You may receive one final confirmation message. If your number changes, you are responsible for updating it by contacting us. We do not guarantee delivery of text messages and are not liable for delays or failures caused by carriers or factors outside our control. We may change message frequency or end programs at any time.
FEEDBACK
If you submit suggestions, ideas, or other feedback (“Feedback”), you agree that Feedback is non-confidential and that we may use it without compensation. You grant us a perpetual, worldwide right to use Feedback for any purpose, including improving our services.
DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Digital Services and all Content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Your use of the Digital Services is at your own risk.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, MENA Events and its officers, directors, employees, contractors, service providers, licensors, and partners will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of data, revenue, profits, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Digital Services.
If any liability cannot be excluded, our total aggregate liability for claims relating to the Digital Services will not exceed one hundred dollars ($100), except where such limitation is prohibited by law. Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.
CALIFORNIA CIVIL CODE SECTION 1542 WAIVER
You acknowledge you may have claims you do not know about and you waive rights under California Civil Code Section 1542 to the fullest extent permitted by law.
INDEMNIFICATION
You agree to defend, indemnify, and hold harmless MENA Events and its affiliates, contractors, and partners from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Digital Services, your User Content, your violation of these Terms, or your infringement of any rights of a third party.
DISPUTE RESOLUTION, ARBITRATION, AND CLASS WAIVER
Informal resolution first: Before initiating arbitration or court proceedings, you agree to contact us with a written description of the issue and the relief you seek, and to attempt in good faith to resolve the dispute informally.
Arbitration: Except for disputes that may be brought in small claims court (if eligible) or claims seeking injunctive relief for misuse of our intellectual property, you and MENA Events agree that disputes arising from or relating to these Terms or the Digital Services will be resolved by binding, individual arbitration.
Class waiver: You and MENA Events agree to bring claims only in an individual capacity and not as part of a class, collective, representative, or private attorney general proceeding, to the fullest extent permitted by law.
Opt-out: You may opt out of arbitration and the class waiver by sending written notice within 30 days of your first use of the Digital Services. Include identifying information and a clear statement that you are opting out. Send opt-out notices to: [Insert Email for Legal Notices].
Location and law: Unless required otherwise by law, arbitration or proceedings will take place in California, and these Terms are governed by California law and applicable federal law, without regard to conflict of law rules.
MODIFICATIONS AND SERVICE AVAILABILITY
We may modify, suspend, or discontinue any part of the Digital Services at any time. We do not guarantee uninterrupted or error-free operation and are not responsible for disruptions caused by factors outside our control.
EXPORT CONTROLS AND SANCTIONS
You may not use the Digital Services in violation of U.S. export controls or sanctions laws. By using the Digital Services, you represent you are not located in a sanctioned country or on a prohibited/restricted party list.
COMPLIANCE WITH LAWS
You are responsible for complying with all applicable laws in connection with your use of the Digital Services. We make no representation that the Digital Services are appropriate or available for use in all locations.
CHANGES TO THESE TERMS
We may update these Terms at any time. Changes are effective when posted. Your continued use after changes are posted constitutes acceptance of the updated Terms.
MISCELLANEOUS
If any provision of these Terms is found unlawful or unenforceable, the remaining provisions remain in effect. We may assign these Terms as part of a business transaction. These Terms constitute the entire agreement regarding your use of the Digital Services and supersede prior understandings on that subject. Any claim relating to the Digital Services must be filed within one (1) year, to the extent permitted by law.

YOUTUBE API TERMS (IF APPLICABLE)
If our Digital Services display YouTube content using the YouTube API, your use of that functionality is subject to YouTube’s Terms of Service.
MOBILE DEVICES AND APP STORE TERMS (IF APPLICABLE)
If you access our Digital Services via mobile devices, your carrier charges may apply. If you download an app through an app store, your use may also be subject to that store’s terms.
